A federal judge on Thursday dismissed a lawsuit accusing the government of illegally suppressing evidence for Viagra, a drug sold on the black market by criminals.
The lawsuit, filed in the U. S. District Court for the Southern District of New York, accused the government of unlawfully suppressing evidence about how it priced drugs.
The lawsuit alleges that Viagra, a popular erectile dysfunction drug, had a black market price of between $6,400 and $10,000 a year.
The government’s lawsuit, filed by the National Association of Boards of Pharmacy, states that a black market of Viagra “is not safe and is inadvisable” for those who buy it online, it alleges.
“Viagra is a controlled substance,” the lawsuit reads.
“The Food and Drug Administration has the discretion to determine whether a drug is safe and appropriate for a particular individual,” it continues. “Consumers should consult their doctor before purchasing or consuming any drug, medicine, or device that they may be considering for their medical condition, even if the person has not previously received any prescription, device, or other medical treatment for that condition.”
The FDA has also issued a warning about “unusual drug interactions,” including a connection between Viagra and Alzheimer’s disease, according to the lawsuit. “All prescription drugs are controlled substances, so there is no guarantee that all of these drugs will be safe and effective in the future.”
“We cannot ignore the facts,” said John P. Kallin, a lawyer for the plaintiffs.
“The FDA’s actions, in some cases, are justifiable because they are dangerous,” Kallin said.
The lawsuit also alleges that Viagra was bought from an Internet pharmacy, as the drug was not sold on the black market.
“Viagra is a controlled substance and it has been regulated by the FDA,” Kallin said.
“Consumers should not purchase drugs without a doctor’s recommendation.”
The lawsuit is not the first that has been dismissed. In the wake of the U. Supreme Court’s decision in Lilly’s against the government over its anti-psychotic drug Zyprexa, the U. Food and Drug Administration has been sharply restricting Internet pharmacies from selling Viagra, a drug that is now widely marketed on the black market.The Food and Drug Administration has also warned about the dangers of “unusual drugs” that can have serious medical consequences, such as Alzheimer’s disease and stroke.
The FDA’s action stems from a lengthy investigation by federal prosecutors and the Department of Justice, which has turned a previously-closed Web site that was operated by a former doctor into a criminal enterprise.
The investigation was conducted by the New York-based law firm of Sallielland & O'Connor LLP and by U. Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations, which has investigated and arrested more than a dozen people for allegedly smuggling prescription drugs into the United States.
The lawsuit alleges that the government and the FDA illegally suppressed evidence about how it priced drugs, and the FDA’s refusal to allow the seizure of the evidence.
The lawsuit alleges that the FDA failed to give appropriate warnings to consumers about the potential dangers of Viagra.
The case was brought by the National Association of Boards of Pharmacy and the National Association of Boards of Pharmacy.
Pfizer Inc. and GlaxoSmithKline Corp. are the manufacturers of Viagra. The company is the company that produces the drug, Eli Lilly and Company.
Pfizer’s website says it is selling the drug through a “pharmacy chain,” which it said is sold to “millions of U. customers”.
In June, a federal judge in Houston ordered Pfizer to stop selling the drug, citing a complaint by the plaintiffs and a settlement agreement with the U. government.
The company, which sells its drugs as a by-product of the manufacture of impotency drugs, has said that the company had “no knowledge” that Viagra was being sold by an online pharmacy.
